UAE tax residency: the 90-day and 183-day rules

In short

The UAE grants tax residency to individuals who spend 183 days or more in the UAE in a 12-month period, or 90 days or more if they are UAE citizens, residents or GCC nationals with a permanent home or job in the UAE. There is no personal income tax, but you still need to count days — both to qualify for a UAE tax residency certificate and to avoid staying resident somewhere else at the same time.

Why UAE residency matters

The UAE has no personal income tax, which is exactly why so many globally mobile professionals base themselves there. But "living in Dubai" is not enough by itself: to get a UAE tax residency certificate — often needed to claim treaty benefits or to satisfy a bank or another tax authority — you must meet the day-count tests in the UAE's domestic rules.

The two thresholds

  • 183 days — anyone physically present in the UAE for 183 days or more in a rolling 12-month period qualifies as a UAE tax resident.
  • 90 days — UAE citizens, UAE residence-visa holders and GCC nationals qualify at 90 days if they also have a permanent place of residence in the UAE or a job or business there.

There is also a facts-and-circumstances test for people whose usual or primary place of residence and centre of financial and personal interests is in the UAE.

The trap: staying resident elsewhere

Being UAE resident does not automatically stop you being resident in the UK, India or anywhere else — each country applies its own test to the same calendar. A common pattern is qualifying in the UAE at 90+ days while accidentally tripping the UK sufficient-ties test or India's 120-day rule during visits home.
